Thank you for visiting TBM Consulting Group’s (“TBM”) website. This Privacy Policy tells you how we use, process, and disclose your information, including personal information, collected at this site and in conjunction with the TBM’s subscription service.

These practices may be changed, but any changes will be posted and changes will only apply to activities and information on a going forward, not retroactive basis. You are encouraged to review the Privacy Policy whenever you visit the site to make sure that you understand how any personal information you provide will be used.

Note: the privacy practices set forth in this Privacy Policy are for the website, as well as the related website for Dploy Solutions which, is a division of TBM (collectively, the “website”), and TBM’s subscription service only. When this policy mentions TBM, Dploy Solutions, “we,” “us,” or “our,” it refers to TBM Consulting Group, TBM Leadership Solutions, LLC, an affiliate of TBM Consulting Group, and Time Based Management Consulting Mexico S. de R.L.de CV, which are responsible for your information under this Privacy Policy (the “Data Controller”).

Collection of Information

We collect personally identifiable information, like names, postal addresses, email addresses, etc., when voluntarily submitted by our visitors. The information you provide is used to fulfill your specific request and then places you on our mailing list. We never sell your information to any other company or agency. Below, we describe more specifically how we collect your information and what we do with it.

1. Information You Give to Us.

  • Information that is necessary for the use of the website and subscription service. We ask for and collect the following personal information about you when you use our website and/or subscription service. This information is necessary for the adequate performance of the contract between you and us and to allow us to comply with our legal obligations. Without it, we may not be able to provide you with all the requested services.
  • Account Information. When you sign up for TBM’s subscription, we require certain information such as your first name, last name, company, country, and email address.
  • Communications with TBM. When you communicate with TBM, we collect information about your communication and any information you choose to provide.
  • Information you choose to give us. You may choose to provide us with additional personal information in order to obtain a better user experience when using the website or subscription service. This additional information will be processed based on your consent.
  • Additional Profile Information. You may choose to provide additional information as part of your subscription such as your title, phone number, and mailing address.

2. Information We Automatically Collect from Your Use of the Website or Subscription Service.

We automatically collect information, including personal information, about the services you use and how you use them. This information is necessary for the adequate performance of the contract between you and us, to enable us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionalities of the website and subscription service.

  • Cookie/Tracking Technology.  TBM uses cookie and tracking technology. Cookie and tracking technology are useful for gathering information such as browser type and operating system, tracking the number of visitors to the website, and understanding how visitors use the website. Cookies can also help customize the website for visitors. Personal information cannot be collected via cookies and other tracking technology; however, if you previously provided personally identifiable information, cookies may be tied to such information. 3. Information We Collect from Third Parties.

We may collect information, including personal information, that others provide about you, or obtain information from other sources and combine that with information we collect. We do not control, supervise, or respond for how the third parties providing your information process your personal data, and any information request regarding the disclosure of your personal information to us should be directed to such third parties.

  • Third-Party Services. If you link, connect, or login with a third-party service (e.g. Google, Facebook, WeChat), the third-party service may send us information such as your registration and profile information from that service. This information varies and is controlled by that service or as authorized by you via your privacy settings at that service.

4. Other Sources.

To the extent permitted by applicable law, we may receive additional information about you, such as demographic data or fraud detection information, from third party service providers and/or partners, and combine it with information we have about you. For example, we may receive background check results (with your consent where required) or fraud warnings from service providers like identity verification services for our fraud prevention and risk assessment efforts.

Use of Information

We use, store, and process information, including personal information, about you to provide, understand, improve, and develop the TBM website and subscription service, communicate with you, and comply with our legal obligations. Specifically, we use, store, and process information to:

  • Enable you to access and use the TBM website and subscription service.
  • Operate, protect, improve, and optimize TBM website and subscription service, such as by performing analytics and conducting research.
  • Maintain the safety, security, and integrity of the website and subscription service.
  • Test, research, and develop service offerings.
  • Provide customer service.
  • Send you substantive content we believe is of interest to you, service or support messages, updates, security alerts, and account notifications.
  • Engage third-party service providers.
  • Prevent and detect fraud.
  • Comply with our legal obligations.
  • We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation. We may do so when: (1) permitted or required by law; or, (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; or, (3) investigating fraud which has already taken place.

Sharing Your Information

1. Your Consent.

Where you have provided consent, we may share your information, including personal information, as described at the time of consent.

2. TBM Affiliates.

We may share your information with our affiliates and subsidiaries for business purposes.

3. Compliance with Law, responding to Legal Requests, Preventing Harm and Protection of Our Rights.

TBM may disclose your information, including personal information, to courts, law enforcement or governmental authorities, or authorized third parties, if and to the extent we are required or permitted to do so by law or if such disclosure is reasonably necessary: (i) comply with our legal obligations; (ii) to comply with legal process and to respond to claims asserted against TBM; (iii) to respond to verified requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity that may expose us, you, or any other of our users to legal liability; (iv) to enforce and administer our Terms & Conditions; or (v) to protect the rights, property, or personal safety of TBM, its employees, or members of the public.

Where appropriate, we may notify you about legal requests unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law; or (ii) we believe that providing notice would be futile, ineffective, create a risk of injury or bodily harm to an individual or group, or create or increase a risk of fraud upon TBM.

4. Service Providers.

TBM uses a variety of third party service providers to help us provide services related to the website and subscription service. Service providers may be located inside or outside of the European Economic Area (“EEA”). These providers have limited access to your information to perform tasks on our behalf, such as website and software optimization, and are contractually bound to protect and to use it only for the purposes for which it was disclosed and consistent with this Privacy Policy. TBM will need to share your information, including personal information, in order to ensure the adequate performance of any contract with you and given our legitimate interest in being able to provide and improve the functionalities of the website and subscription service.

5. Business Transfers.

If TBM undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information, in connection with such transaction or in contemplation of such transaction (e.g., due diligence). In this event, we will notify you before your personal information is transferred and becomes subject to a different privacy policy.

6. Aggregated Data.

We may also share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

Your Rights

You may exercise any of the rights described in this section by contacting TBM through the privacy information provided at the end of this Privacy Policy. Please note that we may ask you to verify your identity before taking further action on your request.

1. Managing Your Information.

Through your account you can manage certain settings, such as to subscribe or unsubscribe to content.

2. Rectification of Inaccurate or Incomplete Information.

You have the right to ask us to correct inaccurate or incomplete personal information concerning you.

3. Data Access and Portability.

In some jurisdictions, applicable law may entitle you to request copies of your personal information held by us. You may also be entitled to request copies of personal information that you have provided to us in a structured, commonly used, and machine-readable format and/or request us to transmit this information to another service provider (where technically feasible).

4. Data Retention and Erasure.

We generally retain your personal information for as long as is necessary for the performance of a contract between you and us, for our legitimate business interests, or to comply with our legal obligations. If you no longer want us to use your information you can request that we erase your personal information. Please note that if you request the erasure of your personal information:

  • We may retain some of your personal information as necessary for our legitimate business interests, such as fraud detection and prevention and enhancing safety.
  • We may retain and use your personal information to the extent necessary to comply with our legal obligations.
  • Some copies of your information (e.g., log records) may remain in our database, but are disassociated from personal identifiers.
  • Residual copies of your personal information may not be removed from our backup systems for a limited period of time.

5. Withdrawing Consent and Restriction of Processing.

Where you have provided your consent to the processing of your personal information by TBM you may withdraw your consent at any time by changing your Account Settings or by sending a communication to TBM specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. Additionally, in some jurisdictions, applicable law may give you the right to limit the ways in which we use your personal information, in particular where (i) you contest the accuracy of your personal information; (ii) the processing is unlawful and you oppose the erasure of your personal information; (iii) we no longer need your personal information for the purposes of the processing, but you require the information for the establishment, exercise or defense of legal claims; or (iv) you have objected to the processing and pending the verification whether the legitimate grounds of TBM override your own.

6. Objection to Processing.

In some jurisdictions, applicable law may entitle you to require TBM not to process your personal information for certain specific purposes (including profiling) where such processing is based on legitimate interest. If you object to such processing, TBM will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defense of legal claims.

Where your personal information is processed for direct marketing purposes, you may, at any time, ask TBM to cease processing your data for these direct marketing purposes.

7. Lodging Complaints.

You have the right to lodge complaints about the data processing activities carried out by TBM before the competent data protection authorities.

Operating Globally

1. General.

To facilitate our global operations, TBM may transfer, store, and process your information within our company or with service providers based in Europe, Asia-Pacific, and North and South America. Laws in these countries may differ from the laws applicable to your Country of Residence.

2. European Economic Area.

If you are a resident of the EEA, the following additional EEA-specific provisions apply to our processing of your personal information. For such residents, the provisions of this EEA Addendum prevail over conflicting provisions of the Privacy Policy.

a. Data Transfers

Information collected within the EEA may be transferred, stored, and processed outside of the EEA for the purposes described in this Privacy Policy. Where we transfer, store, and process your personal information outside of the EEA we have ensured that appropriate safeguards are in place to ensure an adequate level of data protection.

b. Data Subject Rights

If you are an EEA resident, you have rights as a data subject under applicable data protection law. You may exercise these rights, in accordance with applicable law, free of charge unless the request is unfounded, excessive, or otherwise unreasonable, for instance because it is repetitive. In some situations, we may refuse to act or may impose limitations on your rights, as permitted by law.

Your personal information rights include:

  1. the right to request access to your personal information;
  2. the right to receive a copy of your personal information for purposes of transmitting it to another company;
  3. the right to have your personal information corrected or erased/deleted or restricted;
  4. the right to withdraw any consent you have provided to our processing of your personal information; and
  5. the right to object to our processing of your personal information, including profiling.

You may request to exercise these rights by contacting us as specified in the ‘Privacy Contact Information’ section of the Privacy Policy below. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to information or acting on your request to exercise your rights.

Please note that you also have the right under applicable data protection law to lodge a complaint about our processing of your personal information with a data protection supervisory authority.

3. Notice to California Residents.

The California Consumer Privacy Act, (“CCPA”) provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

a. Right to Know, Correct, and Data Portability.

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the “right to know”). Additionally, you have the right to correct information we maintain about you if you believe such information is inaccurate (the “right to correct”). Once we receive your request and confirm your identity (see Exercising Your Rights to Correct, Know, or Delete), we will disclose to you:

  1. The categories of personal information we collected about you.
  2. The categories of sources for the personal information we collected about you.
  3. Our business or commercial purpose for collecting or selling that personal information.
  4.  
  5. The categories of third parties with whom we share that personal information.
  6. If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
  7. sales, identifying the personal information categories that each category of recipient purchased; and
  8. disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
  9. The specific pieces of personal information we collected about you (also called a data portability request).

b. Right to Delete.

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity (see Exercising Your Rights to Correct, Know, or Delete), we will review your request to see if an exception allowing us to retain the information applies. We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.

c. Exercising Your Rights to Correct, Know, or Delete.

To exercise your rights to correct, know, or delete described above, please submit a request by either calling or emailing using the contact set forth in the ‘Privacy Contact Information’ section below. Only you, or a natural person or a business entity registered with the Secretary of State to conduct business in California that you have authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may make a verifiable consumer request on behalf of your minor child. You may only submit a request to know twice within a 12-month period. Your request to correct, know, or delete must:

  1. Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
  2. Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
  3. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. You do not need to create an account with us to submit a request to correct, know, or delete. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

d. Authorized Agents.

If you use an authorized agent, you may provide a power of attorney executed pursuant to California Probate Code sections 4000 to 4465. If a power of attorney that meets those provisions is not submitted, you will be required to provide the authorized agent signed permission to submit a request, verify your identity directly with us, and directly confirm with us that you provided the authorized agent permission to submit the request. If you’re an authorized agent making a request, you need to submit the following to the email address below in our contact information:

  1. email a copy of a power of attorney provided to you by the consumer pursuant to California Probate Code sections 4000 to 4465; or
  2. email proof of signed permission along with a copy of your ID and have the consumer directly confirm with us that they provided you permission to submit the request by sending an email.

e. Response Timing and Format.

We will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically. Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another without hindrance. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

f. Non-Discrimination and No Retaliation.

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  1. Deny you goods or services.
  2. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  3. Provide you a different level or quality of goods or services.
  4. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

4. Notice to Colorado Residents.

Colorado residents have the right to:

  1. Confirm whether we process their personal information;
  2. Access and delete certain personal information;
  3. Data portability;
  4. Opt out of personal information processing for targeted advertising and sales;
  5. Correct inaccuracies in their personal information, taking into account the information’s nature and processing purpose; and,
  6. Opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

To exercise any of these rights, please submit a request using the contact information set forth in the ‘Privacy Contact Information’ section below. To appeal a decision regarding a consumer rights request, please respond to our response to your request, and we will work to process your appeal.

Security

We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use to protect your information are firewalls and data encryption, and information access controls. If you know or have reason to believe that your TBM credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your TBM account, please contact us following the instructions in the Contact Us section below.

Your personally identifiable information is kept secure. Only authorized employees, agents and contractors (who have agreed to keep information secure and confidential) have access to this information. All emails and newsletters from this site allow you to opt out of further mailings.

Changes to This Privacy Policy

TBM reserves the right to modify this Privacy Policy at any time in accordance with this provision. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on our website and update the “Last Updated” date at the top of this Privacy Policy. We will also provide you with notice of the modification by email at least thirty (30) days before the date it becomes effective. If you disagree with the revised Privacy Policy, you may cancel your subscription and refrain from visiting our website. Your continued access to or use of the website and/or subscription service will be subject to the revised Privacy Policy.
